4X4 HUB TERMS AND CONDITIONS
The general terms and conditions of sale detailed below govern the contractual agreement that both “You” or “The Customer “and “Us” or “4x4 Hub” will be entering into during your business transaction with 4x4hub.net.au.
Both parties agree to accept the conditions here noted. These conditions of Sale apply solely to your dealings with 4x4 Hub and replace all other conditions, except those which are governed by your rights as a customer under the Australian Consumer Law.
We maintain that, by confirmation of your order during the checkout process, you have read and agreed to our Terms and Conditions of Sale. These Terms and Conditions are important to you and 4x4 Hub as they are here to protect your rights as a customer of 4x4 Hub and our rights as a business.
4x4hub.net.au is an online business which is constantly changing and updating to suit our customers’ needs. As such, we may alter or remove certain parts of our Website to better suit our core business. We reserve the right to update our Website and the Terms and Conditions which govern sales without notice to our customers. It is your responsibility to read and understand these conditions during your purchase. Your continued use of the Website and by agreeing to our Terms and Conditions will be understood as acceptance of these Terms and Conditions.
We strive to ensure that our Website is always available to you, but we can’t always make this happen, and may be beyond our control. We reserve the right to update the Website as necessary for short periods of time and for general maintenance. We cannot be held liable should our Website be unavailable to you for any length of time.
Parts of the Website require you to input a password to access features. This is to make available your account and orders that are important to you whilst keeping these details private to you. As such we require all users to create an account to ensure you are secured during your business with 4x4hub.net.au. We recommend strong passwords for maximum security of your account and ask that you log out after each session. We do have an account reset procedure should you forget your details.
You must ensure your account remains private to you and not disclose to anyone or a Third Party. Should you believe your account has been breached, please notify us immediately and log in and change your password.
It is a condition of use of 4x4hub.net.au that all the information you provide is correct and up to date. We reserve the right to disable your account at any time and for no reason, including if in our opinion, you have failed to adhere to the Terms and Conditions.
4x4 Hub takes great care when placing product information onto our website, but we cannot be held responsible for any mistakes or omissions on any information given. The technical information provided for products is from the manufacturer and not by us. Likewise the product installation guides for products can be found on the support.kchilites.com/hc/en-us link.
The prices indicated on 4x4hub.net.au are shown in Australian Dollars, which have been converted from American Dollars and include GST but not Delivery. Delivery costs will be calculated at the checkout, however larger items may require you to “Contact Us” for a postage quote.
We reserve the right to modify our prices at any time including on your order or for postage of larger items. If any price is incorrect on our Website and is not corrected on your total at the time of your order being placed, for whatever reason (human error, technical error or other) your order will be cancelled and the payment refunded via your payment method.
4x4hub.net.au will always endeavour to fulfil your order upon completion of payment. If in the event that a product becomes unavailable after your order has been placed and payment has been received, a full refund will be provided and will be paid within 10 working days. If in the event that an order includes items that are temporarily unavailable, the available products will be shipped first and any items outstanding will be shipped when they become available. If a product ordered becomes permanently unavailable a full refund will be provided within 10 working days.
The three available payment methods that 4x4hub.net.au currently offer are:
PayPal, Visa/Credit Card and Direct Deposit.
All payment methods are secured SSL encrypted transactions and do not incur any fees. There is no requirement to hold an account with these Merchants.
Upon completion of a payment, your order will be delivered to the address listed when the order was placed. All products purchased on 4x4hub.net.au are delivered to a physical address, and will not be shipped to Post Office Boxes.
4x4hub.net.au respond to the delivery times listed on their website but do not take responsibility in the event of a late delivery due to loss of package caused by a third-party, contractor, by the buyer, by any unforseen event or by Act of God. An investigation will be conducted in the event of an undelivered parcel within several days of the buyer notifying 4x4hub.net.au, during which there will be no reimbursement or redelivery of product ordered.
When you place your order with us, the stock availability will be that of the website time in which the order was received. We cannot be held responsible for orders being sold out prior to fulfilment and shipment of your order.
Delivery times of your parcel will be that of you chosen delivery method. We are unable to alter these times except whether your chosen method is via express or normal delivery.
Please ensure you check your order upon delivery and note any damage or issues immediately on the delivery docket upon signing for. Please contact us via email or phone and we will assist you further. We ask that you inspect the product for any damage on the day and date of delivery and advise us as quickly as possible. We ask that all damage is reported to us within 48 hours, and inspections for damage to the actual product are reported within 14 days.
4x4 Hub allows 14 days to return products if you are not fully satisfied, we do not accept change of mind returns. Your right of return starts from the moment your order is delivered. You can return the product to us within the said timeframe but this is at your expense, we do not reimburse postage costs to return items.
We request that you send us the products for return by registered post and that you consider purchasing insurance for the product, we do not reimburse for registered post. This is necessary should the products be damaged or lost by your carrier.
The ability to return products is noted as being products in their original packaging, undamaged from opening, complete and in working order. Products will be inspected upon return. Any products that have been found to be damaged, not in the original packaging, or the package has been worn beyond simply opening the product will not be refunded. Please note: Clothing once opened from the original packaging and worn are not returnable due to hygiene reasons.
Deadlines mentioned above are final and cannot be altered.
If the product is returned within 14 days of its delivery, you will be reimbursed via the same payment method as was used initially. If tests need to be undertaken on the product upon return, we will endeavour to do this within 30 days.
Privacy and protection of your personal data is important to us. The details you give us are essential in the processing and delivery of products to you. By registering on our site, you agree to provide us with information which is true and correct. Communicating false and misleading information is contrary to the General Terms and Conditions of our website. You have the right to access your information and update as necessary and can contact us at any time to ascertain what information we have regarding you.
We will at times send you promotional information, newsletters, special offers and giveaways via email. You can opt out of this by contacting us and advising us to cancel this service to you.
Cookies record information which is related to your access to our site. The information allows us to generate statistics and data from visitors to our site and suggest products which you may be interested in. Cookies do not contain any confidential information about you.
All content on 4x4hub.net.au (images, text, videos and other) is the property of 4x4 Hub, its distributors or partners. Any reproduction of this content by any means on any media without written consent is illegal and prosecution may result. 4x4 Hub will not be held responsible under any circumstances if a user of the site violates any of these rules either regarding 4x4 Hub or Third Parties.
Any failure of 4x4 Hub to exercise or enforce any right of the Terms and Conditions shall not constitute a waiver of such right or provision. The Terms and Conditions constitute an agreement between you and 4x4 Hub and govern your use of the service, superseding any prior agreements. If any provisions of the Terms and Conditions is held by a court of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full effect.
4x4 Hub welcomes questions, comments or feedback. Any opinions left on the Website by customers are checked and moderated. If comments infringe or are deemed inappropriate, insulting, out of context or defamatory, 4x4 Hub reserves the right to delete or modify accordingly.
